Terms and Conditions – Unlimited Design Services

Welcome to Graphie Design. These Terms and Conditions (“Terms”) govern your use of our Unlimited Design Services subscription (“Service”). By subscribing to or using our Service, you agree to be bound by these Terms.

1. Definitions
* Company refers to Graphie Design.
* Client refers to any individual or business subscribing to the Service.
* Service refers to the unlimited design request subscription plan provided by the Company.
* Deliverables refer to any designs, graphics, branding materials, or creative assets created under the subscription.

2. Scope of Service
The Unlimited Design Service allows Clients to submit an unlimited number of design requests during an active subscription period, subject to the following:
* Requests are handled one at a time or based on the subscribed queue limit.
* Turnaround times are estimates and may vary depending on complexity.
* “Unlimited” refers to the number of requests submitted, not simultaneous completion of all requests.
* Services are limited to design work only and do not include printing, paid stock purchases, coding, video production, or third-party costs unless otherwise agreed.

3. Subscription and Billing
* Services are billed on a recurring monthly basis unless otherwise stated.
* Payment must be made in advance before work begins.
* Subscription renews automatically unless canceled before the next billing cycle.
* Failure to pay may result in suspension or termination of services.

4. Revisions
* Clients may request reasonable revisions on submitted work.
* Revisions must stay within the original request scope.
* Major changes or new concepts may be treated as a new request.

5. Turnaround Time
* Standard requests are typically completed within 1 business days.
* Larger or complex projects may require additional time.
* No guaranteed deadlines unless explicitly agreed in writing.

6. Client Responsibilities
Clients agree to:
* Provide clear briefs, instructions, and necessary materials.
* Respond promptly to questions or feedback.
* Ensure they own or have rights to any materials submitted to us.
* Use final designs in compliance with applicable laws.

7. Intellectual Property
* Final approved deliverables become the Client’s property after full payment.
* The Company retains rights to unused drafts, rejected concepts, and internal working files unless otherwise agreed.
* The Company may display completed work in portfolios or marketing unless Client requests confidentiality in writing.

8. Prohibited Uses
Clients may not request work involving:
* Illegal, fraudulent, defamatory, or harmful content
* Hate speech, discrimination, or explicit violence
* Infringement of trademarks, copyrights, or third-party rights
* Adult or prohibited regulated content where restricted by law
The Company reserves the right to reject such requests.

9. Cancellation and Refunds
* Clients may cancel anytime before the next renewal date.
* No partial refunds for unused subscription periods unless required by law.
* Refund requests are reviewed case-by-case.

10. Service Availability
We aim to provide consistent service but do not guarantee uninterrupted availability. Delays may occur due to holidays, technical issues, or force majeure events.

11. Limitation of Liability
To the maximum extent permitted by law:
* The Company is not liable for indirect, incidental, or consequential damages.
* Total liability shall not exceed the amount paid by Client during the previous one month of service.

12. Confidentiality
We will use reasonable efforts to keep Client information and materials confidential. Clients should avoid sending highly sensitive information unless necessary.

13. Termination
We may suspend or terminate access if:
* Terms are violated
* Abuse, harassment, or misuse occurs
* Payments are overdue

14. Governing Law
These Terms shall be governed by the laws of Indonesia, unless otherwise agreed.

15. Changes to Terms
We may update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
